These Terms of Service ("Terms") govern your access to and use of the PropertyTitles.com website, platform, applications, and related services (collectively, the "Services") operated by PropertyTitles, Inc. ("PropertyTitles," "we," "us," or "our"), a company headquartered at 100 Financial Center, Suite 2400, Boston, MA 02111. Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By accessing, browsing, or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (available at /privacy), our Acceptable Use Policy (available at /acceptable-use), and all applicable laws and regulations. If you do not agree to these Terms, you must immediately cease all use of the Services.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with a revised "Last Updated" date. Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms.

2. Description of Services

PropertyTitles.com provides a technology platform that delivers access to property title data, ownership records, deed history, lien records, mortgage data, tax and assessment records, building permit data, foreclosure data, automated property valuations (AVM), comparable sales data, and recorded document images. Our data is sourced from county recorder offices, county assessor databases, title plants, and third-party data providers covering over 150 million properties across all 3,143 U.S. counties and territories.

The Services include web-based search functionality, downloadable reports in PDF format, an online dashboard for viewing results, and for qualifying subscribers, access to our REST/JSON API for programmatic data retrieval. The scope, features, and availability of the Services may change at any time without prior notice.

PropertyTitles.com does not provide legal advice, title insurance, or title opinions. Our Services are informational in nature. Users requiring legal interpretations of property records should consult a licensed attorney in the appropriate jurisdiction.

3. Account Registration

To access certain features of the Services, you must create an account. You represent and warrant that: (a) you are at least 18 years of age; (b) all information you provide during registration is accurate, current, and complete; (c) you will maintain the accuracy of such information; and (d) your use of the Services does not violate any applicable law or regulation.

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify PropertyTitles of any unauthorized use of your account. PropertyTitles will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscription Plans and Billing

PropertyTitles offers multiple subscription tiers: Starter ($79 per month), Professional ($199 per month), and Enterprise (custom pricing). Each tier provides different levels of access, search volume, features, and support as described on our Pricing page.

By subscribing to a paid plan, you authorize PropertyTitles to charge the payment method on file for the applicable subscription fee on a recurring monthly basis. All fees are quoted in U.S. dollars.

5. Free Trial

PropertyTitles may offer a free trial period of seven (7) days with up to ten (10) complimentary property searches. Free trials are limited to one per person, household, and payment method. At the end of the free trial period, your account will automatically convert to a paid subscription unless you cancel before the trial expires.

Subject to these Terms, PropertyTitles grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful purposes including personal property research, real estate investment due diligence, verification of public property records, title verification, legal research, genealogical research, comparable sales analysis, and internal business operations of licensed real estate professionals.

8. Prohibited Uses

You expressly agree that you will NOT use the Services for employment decisions, tenant screening, credit/insurance evaluations, harassment, stalking, unsolicited marketing, unauthorized investigations, automated scraping, reselling data, building competing products, circumventing security, impersonation, or any use that violates applicable law.

All content, data, text, graphics, logos, icons, images, software, and code on the Services is the property of PropertyTitles, Inc. or its licensors and is protected by U.S. and international intellectual property laws.

11. Data Accuracy Disclaimer

The data provided through our Services is sourced from publicly available records. While we endeavor to provide accurate and current information, PropertyTitles does not guarantee the accuracy, completeness, reliability, timeliness, or currentness of any data. Users are solely responsible for independently verifying any information obtained through the Services.

You agree to indemnify, defend, and hold harmless PropertyTitles, Inc. from any claims, damages, losses, and expenses arising from your use of the Services, your violation of these Terms, or your violation of any applicable law.

15. API Terms of Use

If you receive API access, you agree to maintain the security of your API keys, comply with rate limits, and not use the API to build competing products. The API is provided "as is" without warranty.

16. Dispute Resolution

Any disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association in Boston, Massachusetts. These Terms are governed by the laws of the Commonwealth of Massachusetts.

17. General Provisions

These Terms constitute the entire agreement between you and PropertyTitles. If any provision is held invalid, the remaining provisions shall continue. The failure of PropertyTitles to enforce any right shall not constitute a waiver. You may not assign these Terms without prior written consent.
